The Three Tiers of California Overtime

Understanding how daily punches translate into regular, 1.5x, and 2.0x wages.

Tier 1

1.0x Regular Pay

  • • First 8 hours in a workday.
  • • Up to 40 regular hours in a single workweek.
  • • Standard base hourly wage.
Tier 2

1.5x Overtime Pay

  • • Hours 8 through 12 in a single workday.
  • • First 8 hours on the 7th consecutive workday.
  • • Hours over 40 in a workweek.
Tier 3

2.0x Double Time

  • • All hours worked past 12 in a single workday.
  • • All hours past 8 on the 7th consecutive workday.
  • • Double the regular base rate.

California Meal Break Premium Pay Penalty (LC § 226.7)

Under California law (Labor Code § 512 & § 226.7), employers must provide:

  • First Meal Break: At least 30 minutes, uninterrupted and off-duty, before the end of the 5th hour of work. (Can only be waived by mutual consent if the day's shift is 6 hours or less).
  • Second Meal Break: At least 30 minutes before the end of the 10th hour of work.
  • The 1-Hour Penalty: If the employer requires you to work through lunch, takes you off break early, or delays your break past 5 hours, they must pay you 1 additional hour of pay at your regular rate for that workday.
